General 
These are your Kinecta Express VISA® General Purpose Re-loadable (“GPR”) Card Terms and Conditions (the “Terms and Conditions”).  These Terms and Conditions are the contract that establishes the rules that govern the use of the Kinecta Express GPR Card Program (“Program”) by Customer (as defined below) and use of the www.kinectaexpress.com website (the “Site”) by Customer and other visitors.  This document also contains other information regarding additional benefit programs available in the Program.  This document supersedes any Terms and Conditions and Program descriptions you may have received earlier.  Please read these Terms and Conditions carefully and retain a copy for your records. By obtaining the Card from us or by using a product or service from us, you agree that you (and your heirs, successors, representatives and beneficiaries, if any) will be bound by these Terms and Conditions and all amendments hereto in effect from time to time. In these Terms and Conditions, “you” and “your” refer to the Customer.  “We”, “us”, and “our” refer to Kinecta Alternative Financial Solutions, Inc.   “Kinecta Express GPR Accounts”, “Kinecta Express”, and “Accounts” refer to the Kinecta Express GPRProgram. 

Agreement & Amendments
You and visitors to the Site agree to these Terms and Conditions, as amended from time to time. If you do not agree to these Terms and Conditions, please do not use the Site, Voice Response or Kinecta Express GPR Card Service(s).  In order to open an Account, you must be an individual who can lawfully enter into and form contracts under applicable law.  When you give the Card number to a merchant for payment, we will use your Account funds to pay for the goods and services, as well as any fees that may apply to the transaction. These Terms and Conditions are subject to applicable federal laws and, to the extent not preempted by federal law, the laws of the state of California (except to the extent that these Terms and Conditions can and do vary such rules or laws), without regard to conflicts of law principles.  You understand and agree that we may impress and enforce (offset), to the fullest extent allowable under the law, from your GPR Card for monies owed to us.

Customer Identification Requirements
To assist the government fight against the funding of terrorism and money laundering, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account (as defined by Federal and State laws).  By enrolling in the Program you guarantee the information you provided is accurate and not falsified. What this means for you when you request the Kinecta Express Card, We will ask for your name, address, date of birth, and other information that will allow us to identify you.  We may also ask to see your driver’s license or other identifying documents meeting our customer identification requirements.  We reserve the right to (i) accept or decline a request to provide you with a Kinecta Express Card; and (ii) discontinue providing the Kinecta Express Card at any time.

Before using the Card
The Card is and will remain our property. However, you will be solely and completely responsible for the possession, use, and control of the Card.  You must surrender the Card to us immediately upon request.  The Card may not be used for Internet lottery, betting, or gambling transactions or for any illegal transactions.  You must activate your Card by calling the number indicated on the sticker on the front of your Card.  During activation you must select a PIN.  You will need your PIN to access cash from ATMs and to use for PIN purchases at merchants.  Be sure to choose a PIN with a number that, while easy for you to remember, may be difficult for someone else to guess.  You may use your Card after activation.  Remember to sign the reverse of the Card. Write down your Card number and the Customer Service Number on a separate piece of paper in case the Card is ever lost or stolen.  At the time of activation, for your protection and for regulatory purposes, you agree to provide identification verification information such as your address, home phone number, date of birth, social security number and additional information as applicable.  We may use this data for a range of purposes, including but not limited to facilitating refunds if your Card is lost or stolen, enhancing usage at merchants that may require zip code authorization, and aiding in collection efforts in the event of a shortage.  We will hold your information in confidence in accordance with the section below entitled “Data Protection and Privacy”.  If you do not wish to provide the data, or if the data you provide us cannot be appropriately verified, we reserve the right to cancel your Card and reimburse you the amount initially loaded on your Card at the time of purchase minus processing fees.

You agree to take all necessary steps to protect your PIN and never disclose your PIN to anyone. As the Card holder you will be responsible for all PIN based transactions that occur on the Card. For security purposes never write your PIN on the Card and never carry a record of your PIN in your purse or wallet.

Using Your Card
The Card is a re-loadable stored-value card. It is neither a credit card, nor a National Credit Union Share Insurance Fund (NCUSIF) insured share account. This card is issued by Kinecta Federal Credit Union pursuant to a license from Visa U.S.A® Inc., your Card allows you to access your prepaid funds at ATMs, which display the VISA® brand in addition to NYSE, STAR, and Plus.  You may also use your Card at merchants who accept VISA® debit cards worldwide.

The Card is non-transferable. The person who purchases the Card is the only person authorized to use the Card.  Please do not give your Card to anyone else to use.  If you permit someone else to use your Card and you give that person your PIN, we will treat this as if you have authorized this person to use your Card and you will be responsible for any transactions initiated by such person with your Card.

You may only use the Card when there is a balance available on the Card and only up to the amount left on the Card plus any transaction fees due.  Use at an ATM or for purchases will be deducted from your Card, including any transactional fees. Any transaction made that exceeds the available balance plus the charged transaction fees will be declined.

Some VISA® merchants may, subject to limits, allow you to use your Card for cash-back on purchases and cash may be advanced at a VISA® affiliated financial institution (some fees may apply).

ATM Safety
If the ATM you are using is inside a building, close the entry door completely upon entering.  Individuals who have a legitimate need to gain access to an ATM should have an access device. Put withdrawn cash in a secure place before stepping away from the ATM. Be aware of your surroundings. If you believe you are being watched or followed, cancel your transaction, and then go to a well-populated area. If necessary, call the local police. Do not write your PIN on or near the Card. Do not give your PIN to anyone else. In case of an emergency, call 911. 

Purchases
When using the Card, some merchants will secure an authorization/approval on the Card for approximately 20 percent more than the total bill.  As an example this is done to take into account a tip/gratuity; however, any amount held, not authorized by you will become available in 3-5 business days.
To use your Card at a gas station, you should pay the attendant since your Card does not allow paying at the pump. 

If you use the Card to make a telephone call this may require a minimum of $15 credit on your Card.  When making a purchase on the phone, by mail or online the account information you provide must be the same account information as registered for the Card.  Any differences in the information will lead to a declined authorization.

If you use the Card to buy goods and you want to use some other method of payment for part of the cost please advise the store in advance and use the Card first before paying any balance by other means. We do not guarantee that the establishment will fulfill this request.

Foreign/Cross Boarder Transactions
Foreign Exchange/Cross-Border Fee - 1% - If a card transaction is made in a currency other than U.S. Dollars, the amount will be converted into the appropriate currency at an exchange rate on the day the transaction is processed. The exchange rate used is the wholesale money market or the government-mandated rate increased by 1% (including the VISA handling charge of 1%). If a transaction is made outside the U.S. but in U.S. Dollars, a Cross-Border Fee of 1% will apply.

Address or Name Changes
You are responsible for notifying us of any change in your physical address, mailing address, e-mail address or your name, as soon as possible after said change. Any notice of change of address required by this agreement may be made by notifying us on Kinecta Express’s secure website www.kinectaexpress.com; otherwise, you can call 1.800.418.3942.   We will attempt to communicate with you only by use of the most recent e-mail address or text message address you have provided to us and you agree that any notice or communication sent to you at the address noted in our records shall be effective unless we have received and processed a valid address change notice from you.

Card Activity Information
You can review your personalized Card balance by visiting www.kinectaexpress.com where full details of all transactions are available free of charge or by calling us toll-free at 1.800.418.3942 (fees may apply for voice response usage).
This information is available to you 24 hours a day, 7 days a week. Your Card account number and some of the information requested when you ordered the Card are required for authentication.

Card Load & Reload
Once your card is registered, you can reload money by visiting any Nix branch location, any Visa® ReadyLink location, or any MoneyGram Authorized Agent. In addition, you may arrange to have all or a portion of your paycheck, government benefits payment, or other check, electronically deposited to your Card via the Automated Clearing House (“ACH”) system (“Direct Deposit” or “ACH Deposit”). For security reasons, there may be limits on the amount, number, or type of reloads you can make to your GPR Card.

ATM Usage & Over-the-Counter Cash 
The frequency, amount, timing of cash withdrawals made from ATMs and over-the-counter may be limited.  ATM usage is subject to a transaction withdrawal and transaction limit within a 24-hour period.  There may be other limitations on the types, frequency, and timing of cash withdrawals established by us from time to time, without notice, for security purposes.  In addition to our ATM withdrawal and transaction limits described below additional fees may be imposed by an ATM operator when you initiate a withdrawal or balance inquiry at an ATM network used to complete the transaction. This surcharge may not be apparent at the time of the withdrawal, but will be deducted from the Card.

Arbitration
We utilize a system of binding arbitration for disputes which cannot be resolved by other means, and which would otherwise be subject to resolution in court. Any controversy or claim between you and us, including, but not limited to, those arising out of or relating to the Card, these Terms and Conditions, or any related agreement shall at the request of either party be determined by arbitration. The arbitration shall be governed by the Federal Arbitration Act (Title 9, U.S. Code), notwithstanding any choice of law provision in this Agreement, and under the authority, and the applicable consumer rules and procedures of, the American Arbitration Association then in effect. Arbitrator(s) must be licensed attorneys with expertise in the substantive laws applicable to the subject matter of the dispute. The arbitration shall take place in the state in which you live. Neither you nor we shall be entitled to join or consolidate disputes by or against others in any arbitration, or to include in any arbitration any dispute as a representative or member of a class, or to act in any arbitration in the interest of the general public or in a private attorney general capacity.

No Warranty of Availability or Uninterrupted Use
From time to time due to circumstances beyond our control, including but not limited to system failures, fires, floods, natural disasters or other acts of God, Our service may be inoperative, and when this happens, you will be unable to obtain information about your Account(s) balance and transaction history, or use your Card to pay for purchases or withdraw funds from ATMs or load funds at authorized locations. We will incur no liability to you because of the unavailability of any funds to you resulting from these events.

Modifications of the Service
We may at our discretion give you notice as provided by law to change or discontinue any aspect or feature of our Program at any time, with no liability to you; including, but not limited to, terms and conditions of use, fee structure, hours of availability, and equipment or information needed for access or use.

Card Expiration & Lost Stolen
Your Card will expire on the date embossed on the front of the Card.
The Card is our property and we may revoke the Card at any time without cause or notice. You must surrender a revoked Card and you may not use an expired or revoked Card. Upon revocation any amount remaining in your Card, after deducting all applicable fees, will be returned to you.

You agree to notify us promptly if the Card is lost or stolen. A replacement Card will be issued for the balance remaining on the Card at the time it is reported lost or stolen (subject to unauthorized use of the Card as set out below and any applicable fees).
We may change the Terms and Conditions or any features of the Card, and we will give you notice of any such change as required by law.

Any entity honoring the Card is required to obtain approval or authorization for any transaction. The balance available for authorizing transactions with the Card is the lesser of your available balance or any dollar limitation disclosed for the transaction being performed. You may use your Card only in the manner and for the purposes authorized by this Agreement.

You have the right to stop payment on any purchase transaction originated by use of the Card. We are not responsible for any injury to you or to anyone else caused by any goods or services purchased or leased with your Card. If you are entitled to a refund for any reason for goods or services obtained with a Card, you agree to accept credits to your Card in place of cash.

We may suspend access to your Card if we notice excessive use of your Card or other suspicious or potentially illegal activities. Access will be reinstated once we have notified you, clarified the situation and rectified any problems.

Fraudulent or Criminal Account Activity
We reserve the right to block or cancel an Account(s) if that Account(s) is associated with any fraudulent, suspicious or criminal activity or any activity not compliant with these Account Terms and Conditions, and we will incur no liability to you because of the unavailability of these funds.  In the event that you believe that you are a victim of identity theft, we suggest that you contact the fraud department of each of the 3 major credit bureaus and that you request that the credit bureaus place a fraud alert and a victim’s statement in your file.  The following are the telephone numbers for the fraud departments of the 3 major credit bureaus:

Unauthorized Use of Your Card
VISA’s
® zero liability policy may protect you from liability for certain unauthorized transactions. Under VISA’s® zero liability policy, unless you have been grossly negligent or have been engaged in fraud, you will not be liable for any signature based card transactions made with your lost or stolen Card.  If you are grossly negligent or have engaged in fraudulent conduct, you could lose all the money in your account. A transaction is unauthorized if it is not initiated by you, you did not give permission to make the transaction and you do not benefit from the transaction in any way. Any unauthorized signature based card transactions will be re-credited to your Card within five (5) business days. If your account history has transactions that you did not make, tell us at once by calling, toll-free, 1.800.418.3942.

Zero Liability
VISA’s® Zero Liability policy means 100 percent protection for you. Visa’s enhanced policy guarantees maximum protection against fraud. You now have complete liability protection for all signature based card transactions that take place on the Visa system. Should someone steal your card number while you’re shopping, online or off, you pay nothing for this fraudulent activity.  Please note that your PIN based transactions are not covered by VISA’s® Zero Liability policy which means that you will be solely responsible for any authorized or unauthorized PIN transactions on your Card.
If you notice fraudulent activity on your card, promptly contact us at 1.800.418.3942 or visit the Site to report it. It is important to continually monitor your transaction history in order to identify any unauthorized transactions.

Cardholders should always regularly check their transaction history for accuracy. You may have greater liability if we reasonably determine that the unauthorized transaction was caused by your gross negligence or fraudulent action—which may include your delay for an unreasonable time in reporting unauthorized transactions. 

No Warranty Regarding Goods and Services
We are not responsible for the quality, safety, legality, or any other aspect of any goods or services purchased. We do not verify or substantiate the claims of any advertiser at the Site.

Termination
We reserve the right to terminate this Agreement or any of the services that are described herein by giving you written notice. You may, at any time, terminate this Agreement by calling us, toll-free, at 1.800.418.3942. Termination will not affect any of our rights or your obligations arising under this Agreement prior to termination.

Other Terms
Your Card and your obligations under this Agreement may not be assigned.  Use of your Card is subject to all applicable rules and customs of any clearinghouse or other association involved in transactions.  We do not waive our rights by delaying or failing to exercise them at anytime.  If any provision of this Agreement shall be determined to be invalid or unenforceable under any rule, law, or regulation of any governmental agency, local, state, or federal, the validity or enforceability of any other provision of this Agreement shall not be affected.

Telephone Monitoring/Recording
From time to time we may monitor and/or record telephone calls between you and us to assure the quality of our customer service or as required by applicable law.

Our Liability  
If we do not complete a transfer from the Card on time or in the correct amount according to these terms and conditions we will be liable for your losses or damages to the extent of the amount to be transferred. However there are some exceptions. We will not be liable, for instance:

  • If through no fault of ours, an ATM or merchant refuses to honor the Card.
  • If through no fault of ours, you do not have enough money available on your Card to make a withdrawal or purchase.
  • If the terminal or system was not working properly and it was known about when the transaction started.
  • If circumstances beyond our control; (such as flood or fire) prevent the transfer, despite reasonable precautions that we have taken.
  • If the Card is damaged or revoked.
  • If the Card has been reported lost or stolen.
  • If we have reason to believe there is something wrong, for example, that the Card has been stolen.
  • If the transaction information supplied to us by you or a third party is incorrect or untimely.
  • The merchant authorizes an amount greater than the purchase amount.
  • Other exceptions stated in these terms and conditions.

Assignment
We may at any time and without notice to you assign the Card, this Agreement or any of our rights or obligations under the Card or this Agreement to any person or entity. The person or entity to which we make any such assignment shall be entitled to all our rights and/or obligations under this Agreement, to the extent assigned.

Data Protection and Privacy
We strive to keep our records of Customer Information accurate and up to date. When you notify us of an error, we will update or correct any erroneous information. Should our member relationship end the Privacy Policy will continue to apply to Customer Information. Please refer to the link below for our policies on information collection and sharing http://www.kinectaexpress.com/privacy.

Unclaimed Funds
If you have not used the full prepaid amount that was available on the Card by the end of the term, you may request a refund of the remaining value (less applicable fees) be issued to you by contacting us at 1.800.418.3942.  If you do not claim the remaining value for a period required under applicable state law, we may be legally required to “escheat” the value, which means we may be required to deliver the remaining value to the state.

ATM fees
When you use an ATM, you may be charged a fee by the ATM operator or network, in addition to Card related fees as outlined in these Terms & Conditions. You may be charged a fee for a balance inquiry even if you do not complete a transaction.

Fee Schedule
By enrolling in the Kinecta Express GPR Program, you agree to pay any and all associated program fees as outlined in the fee schedule. 

Website Usage Terms

1. Use of the Site
a. We are providing the site for the personal use for your use. Use of the site is subject to these Website Usage Terms.
b. You are not authorized to delete or change any copyright, trademark, or other proprietary notice. You may not retransmit, republish, distribute, re-engineer, or make multiple copies of the Site or any portion thereof without our prior written consent. You may not take any actions that alter, interfere with, or unreasonably burden the content or functioning of the Site. You may not “mirror” any content contained on this Site on any other server without our express written permission.
c. You may not post or transmit through this Site any material that we determine:

  • Infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights;
  1. Is unlawful, threatening, abusive, defamatory, or invasive of the privacy or publicity rights of others;
  2. Contains advertising, solicitations, bulk emails or spam, chain letters, pyramid opportunities, or offers for the sale of goods;
  3. Is vulgar, obscene, profane or otherwise objectionable;
  4. Contains viruses, Trojan horses, worms, time bombs, or other computer programming routines that damage, interfere with, capture, intercept, or expropriates our Service or the Site or any data contained therein;
  5. Disproportionately burdens the operation of the Site or our Service;
  6. Encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law.

d. Your right to use the Site will terminate automatically if you breach any of these Website Usage Terms. Upon termination, you agree to immediately delete or destroy any downloaded or printed material obtained from the Site.

2. Facilities Used to Access the Website
You are responsible for obtaining, maintaining, and paying for all telephone, computer hardware and internet services needed for access to our Service(s).

3. Proprietary Rights
a. The Site contains copyrighted material, including text, software, photos, and graphics. The Site and its contents are protected by law, including without limitation United States Copyright Law and International Treaties. We own copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content created by it. Except as permitted herein or with our written permission, you may not copy, redistribute, publish, retransmit, transfer, modify or create derivative works, or in any way commercially exploit, any of the content, in whole or in part. You may download copyrighted material for your personal use only. You are not authorized to change or delete author attribution, trademark legends or copyright notices. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.

b. You will not upload to the Site any material subject to another person’s copyright, trademark or other proprietary right without obtaining such party's permission to do so. By submitting material to any public area of the Site, [and subject only to the our Privacy Statement,] you grant us the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, edit, modify, and distribute such material in whole or in part without geographical restriction, and to incorporate such material into other works. You also authorize any other visitor to the Site to access, view, and store or reproduce such the material for that visitor's personal use.

4. Trademarks
The Kinecta Express logo is a trademark of ours. All other trademarks appearing on the Site are the property of their respective owners. Nothing on the Site should be construed as granting, by implication, or otherwise, any license or right to use any trademark displayed on the Site, without the written permission of the trademark owner.

5. Third-Party Content
We are the distributor of content supplied by third parties and customers. The submitting third parties and customers, and not us, are responsible for any advertisements, opinions, advice, statements, services, offers, or other information or content that they express or make available. We do not guarantee the accuracy, completeness, or usefulness of any such content.

6. Geographical Location of the Website
The Site is controlled and operated by us within the United States. We do not offer the Card to persons residing outside the United States with the following exceptions: Puerto Rico. We make no representation that the content of the Site are appropriate or available for use in other locations. Those who choose to access the Site from other locations do so at their own initiative and are responsible for compliance with applicable local laws.

7. Disclaimer of Warranties; Limitation of Liability
a. The Site is provided on an “as is” basis and without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. We do not warrant that our Service or the Site will be timely, secure, uninterrupted, or error free, or that defects in our Service or our Site, if any exist from time to time, will be corrected. We will not be responsible for errors, omissions, interruptions, deletions, defects, and delays in operation or transmission, communication line failure, or computer viruses associated with the operation of the Site. None of our employees or agents are authorized to create any warranty not expressly made herein. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.
b. Neither we nor any of our officers, employees, or agents will be liable for any indirect, consequential, incidental, special, or punitive damages (including without limitation damages resulting from lost profits or costs of procurement of substitute products or services) arising out of or in connection with the our Service or the Site. In no event will the liability to us or any of our officers, employees, or agents under any theory of liability whether in contract, tort (including negligence or strict liability), or otherwise exceed $500, regardless of whether such parties have been advised of the possibility of such damages. The provisions in this subparagraph may be limited by provisions of applicable law. In particular, some states do not allow limitation of liability in a consumer contract.

8. Monitoring of Communications on the Site
We will have the right (but not the obligation) to monitor chat rooms and forums that occur from time to time on the Site to determine compliance with this Agreement and any of our operating rules, and to satisfy any law, regulation or government request. We may in its sole discretion edit, refuse to post, or remove any material submitted to or posted on the Site.

9. Links to Third Party Websites
The Site may display links to sites sponsored by third parties. We are not responsible for the content or operation of third-party sites, and the presence of such links does not imply that we endorse such sites or third party sponsors.
